This Privacy Policy describes how and when I collect, use, and share information when you purchase an item from me, contact me, or otherwise use my services through Etsy.com. Please read number 9 for returns, exchanges and refunds policies.

This Privacy Policy does not apply to the practices of third parties that I do not own or control, including Etsy or any third party services you access through Etsy. You can reference the Etsy Privacy Policy to learn more about its privacy practices.

1. Information I collect:

To fulfil your order, you must provide me with certain information (which you authorized Etsy to provide to me), such as your name, VALID EMAIL address, VALID postal address, payment information, and the details of the product that you’re ordering. You may also choose to provide me with additional personal information (for a custom orders ), if you contact me directly.

2. The legal base I rely on to collect, use, and share personal information:

I require as the GPDR requres, buyer’s affirmative consent to conduct a transaction between you and I. I do NOT collect any personal information personally, all information I receive is thru Etsy, in order to process your order. I do not send out marketing messages, but Etsy does if you have opted in, My shop and transactions are in compliance and accordance with Etsy's published legal obligations, and any exchange of conversations/emails between you and I are for the sole purpose to fulfill your order properly.

3. Why I Need Your Information and How I Use It

I rely on a Etsy's legal bases to collect, use, and share your information, including:

A. As needed to provide my services, such as when I use your information to fulfil your order, to settle disputes, or to provide customer support;
B. When you have provided your affirmative consent to do business with me.
C. If necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and
as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1a) providing and improving my services. I use your information to provide the services you requested and in my legitimate interest toimprove my services; and 2a) Compliance with the Etsy Seller Policy and Terms of Use. I use your information as necessary to comply with my obligations under the Etsy Seller Policy and Terms of Use.
D. The third parties with whom I share your personal information such as the USPS to provide shipping. I do not process your credit card, Etsy does this, but notifies me of payment only, I have no credit card numbers or personal information given to me by Etsy, only that you paid. If using PAY PAL I comply with Pay Pal's rules and compliance with their GDPR policy and only receive shipping, email information as well as payment has cleared.

4. Information Sharing and Disclosure:

Information about my customers is important to my business. I share your personal information for very limited reasons and in limited circumstances, as follows:

Etsy. I share information with Etsy as necessary to provide you my services and comply with my obligations under both the Etsy Seller Policy and Etsy Terms of Use.
Service providers. I engage certain trusted third parties to perform functions and provide services to my shop, such as delivery companies. I will share your personal information with these third parties, but only to the extent necessary to perform these services.

Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.

5. Data Retention

Etsy retains your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for the following time period: 4 years.

6. Transfers of Personal Information Outside the EU

I do not transfer or store your personal information anywhere outside of Etsy and those sites that require input of your information, for exampl US Postal Service, has their own GDPR guidelines which I abide by. I, personally, as a shop owner, do NOT transfer or share your personal information for anything other than fulfilling your order with my shop after our agreement to do so.

7. Your Rights:

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases below:

For any sort of legal action/reason that might arise. This is unlikely to happen since you and I will have an agreement in place concerning your information etc prior to completion of a sale through my shop on Etsy.

Access. You may have the right to access and receive a copy of the personal information held about you by contacting me using the contact information through my Etsy shop or information supplied to you via Pay Pal if you have used paypal for payment, as well as contacting Etsy directly (to access, correct or delete personal information held by Etsy, you may contact Etsy at Etsy.com/help for assistance, or send a request directly to Etsy) as I utilize their platform and their rules and laws in reference to information storage.

For purposes of EU data protection law, I, SwirlingOrange11, am NOT the data controller of your personal information when doing business on Etsy other than what is necessary to fulfill your order as described above. If you have any questions or concerns, you may contact me through my Etsy Shop.

8. I maintain an email list to send out newsletters etc. ONLY if you have opted in. If you receive any emails with my shop referenced in it without a direct email back to me, it was sent on Etsy's behalf and because you have OPTED IN ON ETSY, NOT WITH MY SHOP.

9. SwirlingOrange11 on etsy does NOT offer refunds, exchanges or returns. Should there be an instance were Shop Owner and Buyer agree to a refund or return, BUYER pays a 25% restocking fee (which includes the total cost of item w shipping included) and/or if a return is warranted, Buyer must return item using USPS PRIORITY MAIL that includes tracking and is paid BY THE BUYER. Tracking must be provided and delivery documented before any refunds are issued.
