(“we”, “us”, “our”)
1. Scope
1.1 These Terms apply to all contracts concluded with consumers via our website, our Etsy shop, or other electronic communication channels.
1.2 Any customer terms that deviate from these Terms apply only if we expressly agree in writing.
1.3 Contract, order and business language is German; this English version is provided for convenience where required.
2. Products, Display, Custom Work
2.1 Product images and descriptions are non-binding. Minor technical or visual deviations (e.g., material/printing tolerances, slight colour variances, visible 3D-printing layers) may occur and do not by themselves constitute a defect.
2.2 Custom/Personalised items: Your specifications (files, measurements, colours, engravings, texts, logos) form the basis of production. You confirm you hold all necessary rights to any content you supply and will hold us harmless from third-party claims.
3. Formation of Contract
3.1 By completing checkout you submit a binding offer.
3.2 A contract is formed when we expressly accept your order (e.g., order confirmation via email/Etsy message) or when we dispatch the goods/start performance.
3.3 For custom orders, we may require a proof/preview approval. Once approved, subsequent changes are possible only with our consent and may incur costs.
4. Prices, Shipping Costs, Payment, Retention of Title
4.1 All prices are final prices including statutory VAT; any shipping costs are shown at checkout.
4.2 Accepted payment methods depend on the checkout system used (e.g., Etsy Payments).
4.3 Goods remain our property until paid in full.
4.4 Statutory default interest applies in case of late payment; reasonable reminder/collection costs may be charged where permitted by law.
5. Production, Delivery, Risk
5.1 Stated production and delivery times are indicative. We will inform you of delays.
5.2 Delivery is made to the address you provide; please ensure its accuracy.
5.3 Transport damage: Please report visible damage to the carrier immediately and notify us. Your statutory rights remain unaffected.
5.4 Partial deliveries are permitted where reasonable and at no extra cost to you.
6. Digital Content / Files (if agreed)
6.1 Where digital content (e.g., STL/3D models, renderings) is supplied, you receive a non-exclusive, non-transferable licence for the agreed purpose.
6.2 Sharing, selling, publishing, or commercially exploiting our design/CAD data without prior written consent is prohibited.
7. Right of Withdrawal (Consumers)
7.1 You have a statutory 14-day right of withdrawal from receipt of goods. See the Withdrawal Information below.
7.2 Exclusions: The right of withdrawal does not apply to goods that are made to your specifications or are clearly personalised, once we have started manufacturing (cf. § 18(1)(3) FAGG).
7.3 To meet the deadline, it is sufficient that you contact us within 14 days (email or Etsy message). We will confirm receipt of your withdrawal on a durable medium (email/Etsy message) and provide return instructions.
8. Returns & Refunds
8.1 Unless otherwise agreed, you bear the direct cost of returning the goods.
8.2 We refund within 14 days from receipt of your withdrawal notice, but not before we have received the goods back or you have provided evidence of dispatch—whichever is earlier. The refund includes the original cost of standard delivery.
8.3 You are liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
9. Warranty (Statutory Liability for Defects)
9.1 Statutory consumer warranty rights apply.
9.2 Usual characteristics of additive manufacturing (layer lines, small dimensional tolerances, slight colour differences) are not defects if fitness for ordinary or contractually agreed use is not impaired.
9.3 Please notify us of defects promptly and include photos where possible to enable swift resolution.
10. Liability
10.1 We are liable as provided by law for intent and gross negligence, for injury to life, body or health, and under the Austrian Product Liability Act.
10.2 For simple negligence, we are liable only for breaches of material contractual duties (cardinal duties) and limited to the typical, foreseeable damage.
10.3 You are responsible for content/files you supply (e.g., logos, 3D models) and warrant that no third-party rights are infringed; you shall indemnify us accordingly.
11. IP, Trademarks & Usage Rights
11.1 We retain all rights in our designs, CAD data, renderings and images unless expressly agreed otherwise.
11.2 With delivery you receive the simple rights necessary to use the specific physical item. This does not include transfer of design files or authorisation to have identical copies made by third parties without our consent.
12. Communication & Contract Text
12.1 We provide contract-related information via email and/or Etsy messages (durable medium).
12.2 Please save the order confirmation/Terms for your records. Full access to the contract text via Etsy may be time-limited.
13. Platform-Specific Terms (Etsy)
13.1 Etsy’s Terms of Use, Policies and Payment conditions apply in addition to these Terms.
13.2 In case of conflict with mandatory Etsy rules, those rules prevail without limiting our obligations to you under the contract.
14. Dispute Resolution; ODR Platform
14.1 The European Commission’s Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/
14.2 We are not obliged or willing to participate in consumer mediation before an ADR entity. Your statutory rights remain unaffected.
15. Governing Law; Jurisdiction
15.1 These Terms are governed by Austrian law, excluding the UN Sales Convention (CISG).
15.2 For EU consumers, the mandatory consumer protection rules of your habitual residence also apply.
15.3 Statutory venue rules remain unaffected.
16. Severability
If any provision is or becomes invalid, the remaining provisions remain effective. The statutory rule shall replace the invalid provision.

Withdrawal Information (Right of Withdrawal)
Right to withdraw
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which you or a third party indicated by you, who is not the carrier, takes possession of the goods.
To exercise the right of withdrawal, you must inform us of your decision to withdraw by means of a clear statement (e.g., email or Etsy message).
You may use the model withdrawal form below, but it is not obligatory.

To meet the deadline, it is sufficient to send your notice of withdrawal within the 14-day period. We will confirm receipt on a durable medium (email/Etsy message).
Effects of withdrawal
If you withdraw, we will reimburse all payments received from you, including delivery costs (except any supplementary costs resulting from your choice of a type of delivery other than our least expensive standard delivery), without undue delay and at the latest within 14 days from the day on which we receive your notice of withdrawal.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.
We will carry out the reimbursement using the same means of payment you used for the initial transaction, unless we have expressly agreed otherwise; in no case will you incur fees as a result of the reimbursement.
Return of goods
You must send back or hand over the goods without undue delay and in any event no later than 14 days from the day on which you inform us of your withdrawal. The deadline is met if you send back the goods before the period of 14 days has expired.
You bear the direct cost of returning the goods.
Compensation for diminished value
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion / early expiry of the right of withdrawal
There is no right of withdrawal for goods that are not prefabricated and are made to your specifications or are clearly personalised, once we have started manufacturing (cf. § 18(1)(3) FAGG).
