APEIRONco Privacy Policy
This Privacy Policy describes how and when I collect, use, and share information when you purchase an item from me, contact me, or otherwise use my services through Etsy.com or its related sites and services. When you make a purchase from my store, you accept the policy written here.
This Privacy Policy does not apply to the practices of third parties that I do not own or control, including Etsy or any third-party services you access through Etsy. You can reference the Etsy Privacy Policy to learn more about its privacy practices.
This store policy covers services and privacy processing. The store's stance on refunds, exchanges, and customer service is included here.
1. Information I Collect
To fulfill your order, you must provide me with certain information (which you authorized Etsy to provide to me), such as your name, email address, postal address, payment information, and the details of the product that you’re ordering. You may also choose to provide me with additional personal information (for a custom order of jewelry, for example), if you contact me directly.
2. The Legal Bases I Rely On to Collect, Use, and Share Personal Information
The GDPR requires that I explain the legal bases I rely on to collect, use, and share personal information. These legal bases include a buyer’s affirmative consent to receive marketing messages, compliance with legal obligations, and my use of the personal information in my legitimate interests. For example:
Why I Need Your Information and How I Use It
I rely on a number of legal bases to collect, use, and share your information, including:
As needed to provide my services, such as when I use your information to fulfill your order, to settle disputes, or to provide customer support;
When you have provided your affirmative consent, which you may revoke at any time, such as by signing up for my mailing list;
If necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and
As necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1) providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services; and 2) Compliance with the Etsy Seller Policy and Terms of Use. I use your information as necessary to comply with my obligations under the Etsy Seller Policy and Terms of Use.
3. The Third Parties with Whom I Share Personal Information
The GDPR requires that you disclose the details of any personal information you share with third parties. I share your personal information for very limited reasons and in limited circumstances, as follows:
Information Sharing and Disclosure
Etsy. I share information with Etsy as necessary to provide you my services and comply with my obligations under both the Etsy Seller Policy and Etsy Terms of Use.
Service providers. I engage certain trusted third parties to perform functions and provide services to my shop, such as delivery companies. I will share your personal information with these third parties, but only to the extent necessary to perform these services.
Business transfers. If I sell or merge my business, I may disclose your information as part of that transaction, only to the extent permitted by law.
Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms, and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.
4. The Length of Time I Keep Personal Information
The GDPR requires you to disclose the period of time during which you will store personal information. I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for the following time period: 4 years.
5. Transfers of Personal Information Outside the EU
GDPR requires you to disclose if you transfer personal information outside of the EU and the legal bases you rely on to do so, such as consent and contractual necessity. I may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, I may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If I am deemed to transfer information about you outside of the EU, I rely on Privacy Shield as the legal basis for the transfer, as Google Cloud is Privacy Shield certified.
6. Your Rights Regarding My Use of Your Personal Information and Contact Details
Based on GDPR requirements, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. These rights are described below:
Your Rights
Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.
Change, restrict, delete. You may also have rights to change, restrict my use of, or delete your personal information. Absent exceptional circumstances (like where I am required to store data for legal reasons), I will generally delete your personal information upon request.
Object. You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
Complain. If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.
Returns and Exchanges
Return and Exchange Policy
I do not accept returns or exchanges due to the nature of my products. Each item is made to order and custom-printed, which means that returns and exchanges are not feasible under normal circumstances. No refunds are provided once the product has been sent for production. In this case, you must inform me that you want your cancellation to take place before the confirmation message I will send you.
However, if your item arrives damaged, defective, misprinted, or incorrect due to an error in shipping or manufacturing, I offer a resolution through a refund or reprint of the product.
Conditions for Refunds or Reprints
If there is an issue with your order, please contact me through Etsy within 2-3 days of receiving your item. Provide detailed images of the defective product and a description of the issue.
Once the issue is verified, I will offer you the option of a refund or a reprint based on your preference.
Please note that I am not responsible for any damage or issues that arise from customer use after the product has been delivered. My responsibility is to ensure you receive the product as described in the listing, in good condition, and within the expected delivery time.
Exclusions
Custom or personalized orders, digital downloads, and items on sale cannot be returned or exchanged unless they arrive damaged or defective due to an error on my part.
