General terms and conditions & cancellation policy
Right of revocation You can revoke the purchase contract for the items purchased from Sabine Fedrowitz (hereinafter referred to as "supplier") without giving reasons within 14 days of receipt of the goods. The right of withdrawal is excluded if the works of art were clearly tailored to personal needs (e.g. dedication) or a commissioned work was created. To meet the deadline, it is sufficient to notify us of the cancellation within this period by email, telephone or post to: Sabine Fedrowitz, Tel.: *49 (0)2131 3655983 or by returning the goods with sufficient postage to: Sabine Fedrowitz, Maubisstr.23 D-41564 Kaarst . In the event of cancellation, payments already made will be credited after the goods have been returned. The return carrier is the buyer. If the goods show signs of use or damage when they are returned, we reserve the right to assert claims for compensation. Please note: Please always send the item back to us in full - this ensures quick processing.
Shipping costs * Customs duties 2.1. With the provider, you usually pay a flat-rate shipping fee regardless of the order value. This will be shown accordingly. 2.2. When shipping abroad, the customs duties charged by the respective country are to be paid by the recipient.
Retention of title The goods remain the property of the provider until full payment has been made.
Payment, due date 4.1. The goods are to be paid for in advance. 4.2 Unfortunately, payment by check or cash is not possible. 4.3. We exclude liability for loss when sending cash. 4.4. "Not liking" the execution cannot lead to a reduction in the remuneration.
Copyright 5.1 Each time the work is used, the name of the respective artist (originator) must be given. 5.2 Any use and exploitation of the work is only permitted with the written consent of the artist and is only valid for the agreed duration and the agreed purpose. Unless otherwise agreed, the possession of the work or the transfer of ownership does not entail any exploitation or usage rights under copyright law; this applies in particular to public exhibitions. 5.3 The artist is entitled to appropriate remuneration for each use or exploitation of the work. 5.4 If, contrary to Section 5.2, the exhibition right is expressly granted, the right to current reporting on the work is also granted, as is the right to depict the work on posters, invitations, on the Internet and in the catalog in connection with an exhibition. 5.5 Documents provided for use of the work (photos, slides, texts, etc.) may only be published with the consent of the artist named on the documents and stating his name. 5.6 The resale right (§ 26 UrhG) and the right of access (§ 25 UrhG) are recognized. In addition, there is an obligation to allow the artist to use the work temporarily (e.g. for exhibitions), insofar as this is reasonable.
Guarantee/maintenance/repair 6.1 Guarantees by the artist for artistic design are excluded unless otherwise agreed in the contract. 6.2 Maintenance obligations are not assumed unless they are agreed separately and all costs associated with maintenance are borne by the user and remunerated separately to the artist. 6.3 The artist reserves the right to carry out necessary restoration or repairs for a reasonable fee. If the artist does not carry out the restoration or repairs himself, he/she will provide binding information on their type and execution.
GENERAL PROVISIONS Artist's waiver of exercising or enforcing any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
APPLICABLE LAW AND PLACE OF JURISDICTION These terms and conditions are governed by German law with the exception of its conflict of law provisions and excluding the UN Sales Convention. The courts in Neuss have exclusive jurisdiction for disputes arising out of or in connection with the use of the services and/or these General Terms and Conditions if you are a merchant or do not have a permanent residence in Germany, have moved your place of residence or usual place of residence abroad after these General Terms and Conditions came into effect, or if your domicile or usual place of residence is not known at the time the action is filed.
WRITTEN FORM REQUIREMENT, TRANSLATION OF THE GTC Oral commitments by the provider, their representatives or other auxiliary persons require written confirmation by Ms. Sabine Fedrowitz in order to become effective. These general terms and conditions can also be found translated into English because of the international business relationships of the provider. at
