This Privacy Policy describes how and when DesignersKitCo ("I", "me", "my") collects, uses, and shares information when you purchase an item from DesignersKitCo (https://www.etsy.com/shop/DesignersKitCo), contact me, or otherwise use my services through Etsy.com or its related sites and services.
You agree that by purchasing an item from DesignersKitCo or otherwise interacting with DesignersKitCo, you have read, understood, and agree to be bound by all of the terms of this Privacy Policy. If you do not agree, you must leave DesignersKitCo immediately.
I may change this Privacy Policy from time to time. If I make changes, I will notify you by revising the date at the top of the page.
This Privacy Policy does not apply to the practices of third parties that I do not own or control, including Etsy or any third party services you access through Etsy or through DesignersKitCo. You can reference the Etsy Privacy Policy to learn more about Etsy's privacy practices. I will make every reasonable effort to inform you when I interact with third parties with your information; however, you are solely responsible for reviewing, understanding, and agreeing (or not) to any third-party privacy policies.
Information I Collect
To fulfil your order, you must provide me with certain information (which you authorised Etsy to provide to me), such as your name, email address, postal address, payment information, and the details of the product you're ordering. You may also choose to provide me with additional personal information from time to time if you contact me directly.
Why I Need Your Information and How I Use It
I rely on a number of legal bases to collect, use, and share your information, including:
as needed to provide my services, such as to fulfil your order, settle disputes, or provide customer support;
when you have given your affirmative consent, which you may revoke at any time — for example, signing up for my mailing list or notifications, or consenting to relevant ads through remarketing on platforms such as Facebook or Google;
to comply with a legal obligation or court order, such as retaining purchase information required by tax law; and
for my legitimate interests, where not overridden by your rights, such as (a) providing and improving my services; and (b) complying with the Etsy Seller Policy and Terms of Use.
Information Sharing and Disclosure
Protecting your personal information is important to my business. I share it only for limited reasons and in limited circumstances:
With Etsy, as necessary to provide my services and comply with the Etsy Seller Policy and Terms of Use.
With trusted service providers — including Senja (customer reviews) and, for physical and print-on-demand orders, printing, fulfilment and delivery providers who receive your name and postal address only as needed to produce and ship your order. I share only what is necessary for them to perform these services.
In the event of a business transfer, if I sell or merge my business, only to the extent permitted by law.
To comply with laws, where I have a good faith belief it is reasonably necessary to: (a) respond to legal process or government requests; (b) enforce my agreements and policies; (c) prevent, investigate, and address fraud, security, or technical issues; or (d) protect the rights, property, and safety of my customers or others.
Data Security and Breaches
I take reasonable technical and organisational measures to keep your personal information secure. If a personal data breach occurs that is likely to affect your rights, I will notify the relevant supervisory authority and, where required, affected individuals, in line with my legal obligations.
How Long I Keep Your Information
I retain your personal information only for as long as necessary to provide my services and as described in this Privacy Policy. I may also retain it to comply with legal and tax obligations, resolve disputes, and enforce my agreements. I generally keep your data for up to five (5) years.
Transfers of Personal Information Outside the EU
I may store and process your information through third-party hosting services in the US and other jurisdictions, which may have different data protection laws than yours. Where I transfer personal information outside the EU/EEA, I rely on legally recognised safeguards, such as the EU–US Data Privacy Framework (where the recipient is certified) and/or the European Commission's Standard Contractual Clauses.
Your Rights
If you reside in certain territories, including the EU, you have a number of rights regarding your personal information:
Access: you may request a copy of the personal information I hold about you.
Change, restrict, or delete: you may ask me to correct, restrict, or delete your information. Absent exceptional circumstances (for example, where I must keep data for legal reasons), I will generally delete it on request.
Data portability: you may request the information you provided in a structured, commonly used, machine-readable format, and ask me to transfer it to another controller where technically feasible.
Object: you can object to (i) processing based on my legitimate interests and (ii) receiving marketing messages. I will stop unless I have compelling legitimate grounds or a legal reason to continue.
Complain: if you reside in the EU, you may raise a concern with your local data protection authority.
