PRIVACY POLICY
This Privacy Policy describes how and when I collect, use, and share information when you purchase an item from me, contact me, or otherwise use my services through Etsy.com or its related sites and services.

The following terms and conditions apply to all purchases by the user (defined as “you/your/yours”) from Fandom Cross Stitchery (defined as “we/us/our”). This Privacy Policy does not apply to the practices of third parties that we do not own or control, including Etsy or any third party services you access through Etsy. You can reference the Etsy Privacy Policy to learn more about its privacy practices.

1. WHAT DATA WE COLLECT
We receive, collect and store any information you enter during checkout or provide us in any other way. We may use Etsy's software tools to measure and collect order/site visit information.

To fulfil your order, you must provide us with certain information (which you authorised Etsy to provide to us), such as your name, email address, postal address, payment information, and the details of the product that you’re ordering. You may also choose to provide us with additional personal information (for a custom order, for example), if you leave a review, or if you contact us directly.

2. HOW WE COLLECT YOUR DATA
When you conduct a transaction on Etsy, as part of the process, Etsy will collect personal information such as your name, address and email address, which is then passed onto us.

3. WHY WE COLLECT YOUR DATA
We rely on a number of legal bases to collect, use, and share your information, including:
• As needed to provide my services (e.g. when we use your information to fulfil your order, to settle disputes, or to provide customer support);
• To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages;
• If necessary to comply with a legal obligation or court order or in connection with a legal claim (e.g. retaining information about your purchases if required by tax law);
• To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services;
• As necessary for the purpose of our legitimate interests, if those legitimate interests are not overridden by your rights or interests (e.g. 1. providing and improving our services. We use your information to provide the services you requested and in our legitimate interest to improve our services; and 2. Compliance with the Etsy Seller Policy and Terms of Use. We use your information as necessary to comply with our obligations under the Etsy Seller Policy and Terms of Use.)

4. HOW YOUR DATA IS STORED
For information on how Etsy stores your data, please visit their privacy policy. We have made every effort to abide by the UK GDPR.

For the purposes of sales analysis, we do store some customer data outside of Etsy, in the form of an encrypted and password-protected file.  The computer on which it is stored is password-protected, and protected by antivirus software and regular security updates.

​5. SHARING YOUR DATA
Information about our customers is important to our business. We share your personal information for very limited reasons and in limited circumstances, as follows:
• Etsy. We share information with Etsy as necessary to provide you our services and comply with our obligations under both the Etsy Seller Policy and Etsy Terms of Use.
• Service providers. We engage certain trusted third parties to perform functions and provide services to our shop, such as Royal Mail and other delivery companies. We will share your personal information with these third parties, but only to the extent necessary to perform these services.
• Business transfers. If we sell or merge this business, we may disclose your information as part of that transaction, only to the extent permitted by law.
• Compliance with laws. We may collect, use, retain, and share your information if we have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce our agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of our customers, or others.

We will not share your information to any third party for marketing purposes.

Customers Outside the UK:
By providing your personal data to us, you expressly consent to the processing of your personal data by us or on our behalf. Of course, you still have the right to ask us not to process your data in certain ways, and if you do so, we will respect your wishes.
Sometimes we'll need to transfer your personal data between countries to enable us to supply the goods or services you’ve requested. In the ordinary course of business, we may transfer your personal data from your country of residence to us and to third parties located in the UK (e.g. Royal Mail).
By dealing with us, you are giving your consent to this overseas use, transfer and disclosure of your personal data outside your country of residence for our ordinary business purposes. This may occur because our information technology storage facilities and servers are located outside your country of residence, and could include storage of your personal data on servers in the UK.

6. DATA RETENTION
We retain your personal information only for as long as necessary to provide you with our services and as described in our Privacy Policy. However, we may also be required to retain this information to comply with our legal and regulatory obligations, to resolve disputes, and to enforce our agreements. We generally keep your data for 5 years.

7. HOW WE MAY CONTACT YOU
We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email.

8. YOUR RIGHTS
If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. These rights are described below:
• Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting us using the contact information below.
• Change, restrict, delete. You may also have rights to change, restrict our use of, or delete your personal information. Absent exceptional circumstances (like where we are required to store data for legal reasons) er will generally delete your personal information upon request.
• Object. You can object to our processing of some of your information based on our legitimate interests. In such cases, we will delete your personal information unless we have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
• Complain. If you reside in the EU and wish to raise a concern about our use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

9. UPDATES
We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting.

10. THIRD PARTIES
We may use certain third-party services or apps to enhance our business and your user experience.  We will never disclose or sell your data to these third parties, but some information may be shared with them through the use of our website.
