These privacy rules describe how I collect, use, and share information, as well as the circumstances in which I do so, when you place an order with me or use my services through Etsy.com or related websites and services.
These rules do not apply to the practices of third parties that I do not own or control, including Etsy or any third-party services you may access through Etsy. You can consult Etsy’s Privacy Policy to learn more about how the platform handles privacy matters.
• Information I collect
To process your order, you must provide me with certain information (which you have authorized Etsy to share with me), including your name, email address, postal address, payment details, and information about the product you are ordering.
You may also choose to provide me with additional personal information (for example, for a custom order) by contacting me directly.
• Why I need your information and how I use it
I rely on a number of legal bases to collect, use, and share your information, including:
- To provide my services, for example when I use your information to process your order, resolve a dispute, or provide customer support;
- When you have given me your explicit consent, which you may withdraw at any time, for example by subscribing to my newsletter;
- When necessary to comply with a legal obligation, court order, or legal request, such as retaining information about your purchases to comply with tax regulations; and
- When necessary for my legitimate interests, provided that these interests are not overridden by your rights or interests, such as: 1. Providing and improving my services. I use your information to provide the services you have requested and to improve those services as part of my legitimate interest; 2. Complying with Etsy’s Seller Policy and Terms of Use. I use your information, when necessary, to fulfill my obligations under Etsy’s Seller Policy and Terms of Use.
• Sharing and disclosure of information
Information about my customers is important to my business. I only share your personal information for a very limited number of reasons and in a limited number of circumstances, including:
- Etsy. I share your information with Etsy when necessary to provide my services to you and to comply with my obligations under Etsy’s Seller Policy and Terms of Use.
- Service providers. I rely on certain trusted third parties to perform specific tasks or provide certain services for my shop, such as shipping companies. I may need to share your personal information with these third parties, but only the information that is necessary for them to provide these services.
- Business transfers. If I sell my business or merge it with another business, I may need to disclose your information as part of that transaction, but only to the extent permitted by law.
- Compliance with the law. I may collect, use, retain, and share your information if I believe in good faith that it is necessary and reasonable to: (a) respond to a legal process or government request; (b) enforce my agreements, terms, or policies; (c) prevent, investigate, or address fraud, illegal activity, technical issues, or security concerns; or (d) protect the rights, property, and safety of my customers or others.
• Data retention
I retain your information only for as long as necessary to provide my services and for the purposes outlined in my privacy policy. I may also need to retain this information to comply with legal and regulatory obligations, resolve disputes, and enforce my agreements. I generally retain this information for a period of: 4 years.
• Transfers of personal information outside the EU
I may store and process your information through third-party hosting providers located in the United States or other countries. Therefore, I may transfer your personal information to a jurisdiction where data protection and government surveillance laws differ from those in your country.
If I need to transfer your personal information outside the European Union, I rely on the Privacy Shield framework as a legal basis for such transfers, with Google Cloud benefiting from Privacy Shield certification.
• Your rights
If you are a resident of certain territories, including the European Union, you have certain rights regarding your personal information. Some of these rights apply generally, while others only apply in specific circumstances. These rights are described below:
Access. You may have the right to access the personal information I hold about you and receive a copy of it by contacting me. My contact details are provided below.
Correction, restriction, deletion. You may also have the right to correct your personal information, restrict my use of it, or request its deletion. Except in exceptional circumstances (for example, if I need to retain information related to my business for legal reasons), I will generally delete your personal information upon request.
Objection. You may object to (1) my processing of certain information based on my legitimate interests and (2) receiving marketing communications from me after you have explicitly consented to receive them. In these specific cases, I will delete your personal information unless I have legitimate grounds to continue using it, or where it is required for legal reasons.
Complaints. If you reside in the European Union and wish to raise a concern about my use of your information (without affecting any other rights you may have), you may do so with your local data protection authority.
