FOXGLOW CREATIVE PRIVACY POLICY

This Privacy Policy explains how and when I collect, use and share personal information when you purchase an item from Foxglow Creative, contact me, or otherwise use my services through Etsy.com and its related services.

This policy does not apply to third parties that I do not own or control, including Etsy. Etsy processes personal information under its own Privacy Policy.

1. Personal information I collect

When you place an order, Etsy may provide me with information needed to manage that order and provide customer support. This may include your name, email address, billing country, order details and any information you provide when contacting me through Etsy Messages.

Payments are processed by Etsy. I do not receive or store your full payment-card or bank-account details.

Foxglow Creative currently sells instant digital downloads, so I do not normally require a postal address to fulfil an order.

2. Why I need your information and how I use it

I rely on the following lawful bases to collect and use personal information:

• Contract: to provide the digital products you purchase, respond to questions about an order and resolve problems or disputes.

• Legal obligation: to retain information where required for tax, accounting, fraud-prevention or other legal purposes.

• Legitimate interests: to operate and improve Foxglow Creative, provide customer support, protect the security of the business and comply with Etsy’s Seller Policy and Terms of Use, provided those interests are not overridden by your rights.

• Consent: where you have expressly agreed to a particular use of your information. You may withdraw that consent at any time.

I do not use information obtained through an Etsy purchase to send unsolicited marketing messages.

3. Information sharing and disclosure

Information about customers is important to my business. I share personal information only in limited circumstances:

• Etsy: as necessary to provide my services through the Etsy platform and comply with Etsy’s Seller Policy and Terms of Use.

• Professional and technical services: where reasonably necessary, information may be shared with trusted providers such as accounting, legal, security or technical-support services. Only the information needed to perform the relevant service will be shared.

• Business transfers: if Foxglow Creative is sold, reorganised or transferred, relevant information may form part of that transaction where permitted by law.

• Compliance and safety: I may collect, retain or disclose information where I reasonably believe this is necessary to comply with the law, respond to lawful requests, prevent fraud, enforce agreements, or protect the rights and safety of customers or others.

Foxglow Creative does not currently use a separate production, delivery or file-hosting provider to fulfil Etsy digital orders. Digital files and payments are handled through Etsy.

4. Data retention

I retain personal information only for as long as reasonably necessary to provide my services and meet legal, tax, accounting and dispute-resolution obligations.

Order and transaction records may generally be retained for up to six years after the end of the relevant financial year. Messages and support information may be deleted sooner when they are no longer required, unless they need to be retained for legal or dispute-resolution purposes.

5. International transfers

I do not independently transfer or host Etsy customer information outside the United Kingdom.

Etsy and any services operated by Etsy may process information in other countries under Etsy’s own privacy arrangements and applicable transfer safeguards. Please consult Etsy’s Privacy Policy for information about how Etsy handles international transfers.

6. Your rights

Depending on where you live and the circumstances, you may have rights relating to your personal information, including:

• Access: the right to request a copy of personal information I hold about you.

• Rectification: the right to ask for inaccurate or incomplete information to be corrected.

• Erasure: the right to ask for personal information to be deleted in certain circumstances.

• Restriction: the right to ask me to restrict how your information is used in certain circumstances.

• Objection: the right to object to processing based on legitimate interests or to direct marketing.

• Data portability: the right, in certain circumstances, to receive information you provided in a portable format.

• Withdrawal of consent: where processing is based on consent, you may withdraw that consent at any time.

These rights are not absolute. I may need to retain certain information where required by law or where there are compelling legitimate grounds to do so.

If your request concerns information held directly by Etsy, you may need to contact Etsy through Etsy Support.

You also have the right to raise a concern with the UK Information Commissioner’s Office or, where applicable, your local data-protection authority.

7. How to contact me

For data-protection purposes, I, Phil Lockwood, trading as Foxglow Creative, am the controller of personal information used independently by Foxglow Creative.
