Privacy Policy – The Night We Keep
This Privacy Policy explains how and when I collect, use, and share your personal information when you buy from my shop, contact me, or otherwise use my services through Etsy.com and its related sites and services.
It does not cover the practices of third parties I don't own or control, including Etsy. You can read the Etsy Privacy Policy to learn how Etsy handles your information.
Information I Collect
To fulfil your order, you must give me certain information, which you have authorized Etsy to share with me:
your name
your email address
your postal address
the details of the product you're ordering
Etsy processes your payment, and I never see your card details.
Because every star map is personalized, you also share the details I need to make it. These can include:
names
a date and time
a location or coordinates
a personal message
Sometimes these details concern other people, such as a partner, a child or a loved one who has passed away. Please only share what is needed for your design. I use these details only to create your star map.
Why I Need Your Information and How I Use It
I rely on the following legal bases to collect, use, and share your information:
To provide my services. For example, I use your details to create your personalized design, send you a proof, make revisions, deliver your files, provide customer support, and settle disputes.
With your consent, which you can withdraw at any time. For example, if you ask to hear about new designs or offers. I will never send you marketing messages unless you have clearly agreed to receive them.
To comply with a legal obligation. For example, keeping records of sales as required by Danish bookkeeping and tax law.
For my legitimate interests, where these are not overridden by your rights or interests. These include providing and improving my services, and meeting my obligations under the Etsy Seller Policy and Terms of Use.
Information Sharing and Disclosure
I share your personal information only for very limited reasons:
Etsy. I share information with Etsy as needed to provide my services and to meet my obligations under the Etsy Seller Policy and Terms of Use.
Service providers. I use trusted third-party tools to run my shop: design software (such as Canva), cloud storage, email, and AI tools that help me produce your design. They receive only the information they need to perform their service, and they may not use it for anything else.
Business transfers. If I sell or merge my business, I may disclose your information as part of that transaction, only as far as the law allows.
Compliance with laws. I may collect, use, keep and share your information if I believe in good faith that it is reasonably necessary to:
respond to legal process or government requests
enforce my agreements, terms and policies
prevent, investigate and address fraud, other illegal activity, or security or technical issues
protect the rights, property and safety of my customers or others
Data Retention
I keep your personal information only as long as necessary:
Personalisation details and design files are kept for 6 months after delivery, so I can help if you need a file re-sent or a correction. After that, I delete them, unless you ask me to delete them sooner.
Order and sales records are kept for 5 years from the end of the financial year, as required by Danish bookkeeping law.
Messages are kept for as long as needed to resolve your order and any dispute.
Transfers of Personal Information Outside the EU
Some of the services I use, such as cloud storage and design software, may store or process your information in the United States or other countries outside the European Economic Area. Those countries may have different data protection laws from yours.
When your information is transferred outside the EEA, I rely on one of the following safeguards:
the EU–US Data Privacy Framework, where the provider is certified under it
the European Commission's standard contractual clauses
another safeguard permitted under the GDPR
Your Rights
If you live in certain territories, including the EU, you have rights over your personal information. Some of these apply only in certain cases:
Access. You can ask for a copy of the personal information I hold about you.
Change, restrict, or delete. You can ask me to correct your information, limit how I use it, or delete it. Unless I must keep it for legal reasons, such as bookkeeping, I will delete it on request.
Object. You can object to:
my processing of your information based on my legitimate interests
receiving marketing messages from me, even if you agreed to them earlier
Portability. You can ask me to provide your information in a commonly used format.
Complain. If you live in the EU and are concerned about how I use your information, you can complain to your local data protection authority. In Denmark, this is Datatilsynet (www.datatilsynet.dk). This does not affect any other rights you may have.
How to Contact Me
For EU data protection law, I, [Catherine ], trading as The Night We Keep, am the data controller of your personal information.
If you have any questions or requests about your data, contact me through Etsy Messages or at thenightwekeep@gmail.com.
If you need to access, correct or delete personal information that Etsy holds, please contact Etsy directly at Etsy.com/help.
