This Privacy Policy describes how and when we collect, use and disclose personal information about you when you purchase an item from WebPlannerCo., contact us through Etsy, or otherwise use our services through our Etsy shop.
This policy applies to the personal information that WebPlannerCo. receives or processes as an Etsy seller. Etsy's processing of your information is governed by Etsy's own Privacy Policy and other applicable policies.
Where applicable, we handle personal information in accordance with the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) and applicable international privacy and data protection laws, including the European Union General Data Protection Regulation (“EU GDPR”), the United Kingdom General Data Protection Regulation (“UK GDPR”), and the UK Data Protection Act 2018.

Depending on your interaction with our shop, this may include:

We may also receive information if you contact us directly outside Etsy in relation to an Etsy purchase.

Payments for purchases made through our Etsy shop are processed by Etsy Payments and its payment service providers.
WebPlannerCo. does not receive or store your complete payment card or bank account details through Etsy.
Payment processing and related information are governed by Etsy's applicable policies.
Sensitive Information
We do not request or intentionally collect sensitive or special category personal information through our Etsy shop.
Please do not provide sensitive personal information in Etsy messages or other communications with us unless it is genuinely necessary.
2. Why We Need Your Information and How We Use It
We collect, use and retain personal information only where reasonably necessary to operate our Etsy shop and provide our products and services.
We may use your information to:
process and fulfil your Etsy order;
provide digital products or information associated with your purchase;
communicate with you about your order;
respond to questions, requests or customer support enquiries;
maintain appropriate business, accounting and transaction records;
prevent or respond to fraud, misuse or security issues;
resolve disputes;
establish, exercise or defend legal claims;
comply with Etsy's Seller Policy, Terms of Use and other applicable Etsy requirements; and
comply with applicable laws, taxation requirements, court orders or regulatory obligations.
We do not use information obtained from an Etsy transaction to add you to an email marketing list or send you unsolicited marketing communications without your consent.
3. Our Lawful Bases Under the EU GDPR and UK GDPR
Where the EU GDPR or UK GDPR applies to our processing of your personal information, we rely on one or more of the following lawful bases.
Performance of a Contract
We process information where necessary to fulfil our contract with you, including processing your order, providing purchased digital products and providing customer support relating to your purchase.
Legal Obligations
We may process or retain information where necessary to comply with legal obligations, including taxation, accounting, record-keeping and regulatory requirements.
Legitimate Interests
We may process information where necessary for our legitimate business interests, provided those interests are not overridden by your rights and freedoms.
These interests may include:
operating and administering our Etsy shop;
providing customer support;
maintaining appropriate business records;
preventing fraud or misuse;
protecting our legal rights; and
resolving disputes.
Consent
Where we rely on your consent for a particular use of personal information, you may withdraw that consent at any time.
Withdrawal of consent does not affect the lawfulness of processing carried out before your consent was withdrawn.
4. Information Sharing and Disclosure
We share personal information only where reasonably necessary to provide our services, operate our business or comply with our legal obligations.
Information may be shared with:
Etsy
We share information with Etsy where necessary to provide our services through the Etsy marketplace and to comply with our obligations under Etsy's policies.
Etsy independently processes information in accordance with its own Privacy Policy.
Service Providers
We may engage trusted service providers where reasonably necessary to operate our business, such as:
email and communications providers;
IT and cloud-storage providers;
accounting and bookkeeping providers; and
professional advisers.
We only provide these parties with information reasonably necessary for the relevant service and require appropriate protection of personal information where required by law.
Legal and Regulatory Requirements
We may collect, retain, use or disclose personal information where we reasonably believe this is necessary to:
respond to lawful legal processes or government requests;
comply with applicable laws or regulations;
enforce our agreements;
prevent or investigate fraud, security issues or other unlawful activity; or
protect our legal rights or the rights of others.
Business Transfers
If WebPlannerCo. or SIG Machine Learning Pty Ltd is sold, reorganised, merged or otherwise transferred, personal information may be disclosed as part of that transaction where permitted by applicable law.
5. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy.
The period for which information is retained depends on factors including:
the nature of the information;
the reason it was collected;
our legal, accounting and taxation obligations;
Etsy-related transaction and dispute requirements; and
whether the information may reasonably be required to establish, exercise or defend legal claims.
When information is no longer reasonably required, we will delete, destroy or de-identify it where appropriate, subject to applicable legal requirements.
Information held independently by Etsy is subject to Etsy's own retention practices and policies.
6. International Transfers
WebPlannerCo. is operated by SIG Machine Learning Pty Ltd in Australia.
If you are located outside Australia, personal information that you provide to us or that Etsy provides to us may therefore be processed in Australia.
Some service providers we use may also process information in other countries.
Where the EU GDPR applies and an international transfer of personal information requires safeguards, we will rely on an appropriate transfer mechanism permitted under the EU GDPR, such as an adequacy decision, Standard Contractual Clauses or another permitted mechanism.
Where the UK GDPR applies and a restricted transfer of personal information requires safeguards, we will rely on an appropriate mechanism permitted under UK data protection law, such as UK adequacy regulations, appropriate contractual safeguards or another permitted exception.
Transfers and processing carried out independently by Etsy are governed by Etsy's own privacy arrangements and policies.
7. Your Privacy Rights
Depending on where you live and the laws that apply to you, you may have rights concerning the personal information we hold about you.
These may include the right to:
request access to your personal information;
request correction of inaccurate or incomplete information;
request deletion or erasure of your information;
request restriction of certain processing;
object to certain processing;
receive certain information in a portable format; and
withdraw consent where processing is based on your consent.
These rights are subject to applicable legal requirements and exceptions.
For example, we may be legally required to retain certain transaction information for taxation, accounting, fraud-prevention or legal purposes even after receiving a deletion request.
We may need to verify your identity before responding to a privacy request.
Information Held by Etsy
WebPlannerCo. can only respond to requests concerning personal information that we control or process.
If your request concerns information held independently by Etsy, your Etsy account, payment information, Etsy advertising or other processing carried out by Etsy, you should submit the relevant request directly to Etsy.
8. European Union and EEA Customers
Our Etsy listings are available to customers in the European Union and European Economic Area.
Where the EU GDPR applies to our processing of your personal information, you may have the GDPR rights described in this Privacy Policy.
You also have the right to lodge a complaint with a competent data protection supervisory authority, including a supervisory authority in the EU or EEA country where you live or work, or where you believe an infringement of applicable data protection law has occurred.
WebPlannerCo. is established in Australia and does not currently maintain an establishment in the European Union or EEA.
Under Article 27 of the EU GDPR, organisations outside the EU or EEA may in certain circumstances be required to appoint a representative within the EU or EEA.
An exemption may apply where relevant processing is only occasional, does not include large-scale processing of special category or criminal-conviction data, and is unlikely to result in a risk to the rights and freedoms of individuals, taking into account the nature, context, scope and purposes of the processing.
We periodically review whether an EU representative is required having regard to our activities involving individuals in the EU and EEA.
9. United Kingdom Customers
Our Etsy listings are available to customers in the United Kingdom.
Where the UK GDPR applies to our processing of your personal information, you may have the privacy rights described in this Privacy Policy.
You also have the right to lodge a complaint with the UK Information Commissioner's Office (“ICO”) if you believe that your personal information has been handled in breach of applicable UK data protection law.
WebPlannerCo. is established in Australia and does not currently maintain an establishment in the United Kingdom.
Under the UK GDPR, an organisation outside the United Kingdom that offers goods or services to individuals in the UK or monitors their behaviour may in certain circumstances be required to appoint a representative in the United Kingdom.
An exemption may apply where the organisation's relevant processing is only occasional, is of low risk to individuals' data protection rights, and does not involve large-scale processing of special category or criminal-offence data.
We periodically review whether a UK representative is required having regard to the nature, scope, frequency and risk of our processing involving individuals in the United Kingdom.
10. Australian Privacy Rights
Where Australian privacy law applies, you may request access to or correction of personal information that we hold about you.
If you have a complaint about our handling of personal information, please contact us using the details below.
We will investigate your complaint and respond within a reasonable period.
Where applicable, if you are not satisfied with our response, you may have the right to make a complaint to the Office of the Australian Information Commissioner (OAIC).
11. Security
We take reasonable technical and organisational measures designed to protect personal information against loss, misuse, unauthorised access, alteration and disclosure.
Access to personal information is limited to people and service providers who reasonably require it for legitimate business purposes.
However, no electronic transmission or storage system can be guaranteed to be completely secure.
12. Marketing
We do not use personal information obtained from an Etsy purchase to send unsolicited marketing communications or to add Etsy buyers to external marketing lists without appropriate consent.
If you separately choose to subscribe to marketing communications from WebPlannerCo., you may unsubscribe at any time using the unsubscribe mechanism provided with those communications.
13. Artificial Intelligence
We may use artificial intelligence and machine-learning technologies for internal business purposes such as content creation, product development, quality assurance and business administration.
We do not intentionally provide personal information received from Etsy buyers to AI providers for the purpose of allowing those providers to train their general-purpose AI models.
If an AI service processes personal information on our behalf for another permitted purpose, we will handle that processing in accordance with applicable privacy laws and this Privacy Policy.
We do not use Etsy buyer personal information to make solely automated decisions that produce legal or similarly significant effects concerning you.
14. Children's Information
Our products are not specifically directed at children.
We do not knowingly collect personal information from children through our Etsy shop beyond information that Etsy may provide as necessary to process a transaction.
If you believe that a child has provided personal information to us inappropriately, please contact us.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes to our business, Etsy's services, our processing practices or applicable laws.
The current version will be made available through our Etsy shop or other appropriate location.
Where required by applicable law, we will provide additional notice of material changes.
