Herein "We" refers to the staff of Storm Cellar magazine who may be assigned any task or responsibility related to order fulfillment, inclusive of the publishers, and "You" refers to the customer. In Plain Language, we won't use or share your personal information gathered from Etsy for any purpose except fulfillment of orders, customer service related to specific orders, and fulfillment of legal obligations.
I. Information We Collect:
To fulfill your order, you must provide certain information (which you authorized Etsy to provide to us), such as your name, email address, postal address, payment information, and the details of the product that you’re ordering. You may also choose to provide me with additional personal information if you contact me directly.
II. Why We Need Your Information and How We Use It
The legal bases to collect, use, and share your information include:
• as needed to provide our services, such to fulfill your order, settle disputes, or provide customer support;
• when you have provided your affirmative consent, which you may revoke at any time;
• as necessary to comply with a legal obligation or court order, or in connection with a legal claim or regulation, such as retaining information about your purchases where required by tax law;
• as necessary for the purpose of our legitimate business interests, if those legitimate interests are not overridden by your rights or interests, such as providing and improving our services (we use your information to provide the goods and services you request, and in our legitimate interest to improve our goods and services); and
• as necessary to comply with the our obligations under the Etsy Seller Policy and Terms of Use.
III. Information Sharing and Disclosure
Information about our customers is important to our business. We share your personal information for very limited reasons and in limited circumstances, as follows:
• We share information with Etsy as necessary to provide you with goods and services, and comply with our obligations under the Etsy Seller Policy and Terms of Use.
• We engage certain trusted third party Service Providers to perform business functions and provide services on behalf of our shop, such as delivery companies and postal systems. We share your personal information with third parties only to the extent necessary to perform those functions and services.
• If we sell our business, we may disclose your information as part of that transaction, but only to the extent permitted by law.
• We will collect, use, retain, and share your information if we have a good faith belief that it is (1) legally required to comply with court-ordered government request in our governing jurisdiction; (b) reasonably necessary to respond to legal process; (c) reasonably necessary to enforce our agreements, terms and policies; (d) reasonably necessary to prevent, investigate, and address fraud and other illegal activity, security issues, or technical issues; or (e) reasonably necessary to protect the rights and safety of our customers, or others.
IV. Data Retention
We retain your personal information for as long as necessary to provide you with goods and services and as described in the Privacy Policy and as required by the Etsy Seller Policy and the Etsy Terms of Use. However, we may also be required to retain your personal information to comply with legal and regulatory obligations, to resolve disputes, or to enforce agreements. We generally keep your data for the following time period: 7 years.
V. Transfers of Personal Information from Inside to Outside the EU
We may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, we may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If we are deemed to transfer information about you outside of the EU, we rely on Privacy Shield as the legal basis for the transfer, as Google Cloud, where the data is transferred and housed, is Privacy Shield certified.
VI. Customer Rights
If you reside in certain jurisdictions, including the EU, you have several rights regarding to your personal information. While some of these rights apply generally, certain rights apply only in limited cases. Your rights are described as follows:
• Access. You may have the right to access and receive a copy of the personal information we have about you by contacting us directly via email and providing the relevant order number.
• Changes, restrictions, deletion. You may also have the right to change, restrict use of, or delete your personal information. Absent exceptional circumstances (such as when we are required to store data for legal reasons), we will generally delete your personal information upon request.
• Objections. You can object to (a) our use of some of your information based on our legitimate interests and (b) receiving marketing messages from me after providing your express consent to receive them, by contacting us directly via email. In such cases, we will delete your personal information, unless it is needed for legal reasons, or if we have a compelling business reason (such as an ongoing subscription that is not canceled) for keeping it.
• Complaints. If you reside in the EU and wish to raise a concern about our use of your information (without prejudice to any other rights you may have), you have the right to do so with your local data protection authority. In other jurisdictions you may have the right to raise a concern about our use of your information as provided by law.
