Set Apart Digitalz Privacy Policy

This Privacy Policy describes how and when I collect, use, and share information when you purchase an item from me, contact me, or otherwise use my services through Etsy.com and its related sites and services.

This Privacy Policy does not apply to the practices of third parties that I do not own or control, including Etsy or any third-party services you access through Etsy. You can refer to the Etsy Privacy Policy to learn more about Etsy’s privacy practices.

Information I Collect

To fulfill your order, you must provide me with certain information that you authorized Etsy to provide to me, such as your name, email address, postal address, payment information, and the details of the product you are ordering.

Because Set Apart Digitalz sells digital products, I generally use this information to process and deliver your order, communicate with you about your purchase, and provide customer support.

You may also choose to provide me with additional personal information if you contact me directly, such as through Etsy messages or email.

Why I Need Your Information and How I Use It

I rely on a number of legal bases to collect, use, and share your information, including:

as needed to provide my services, such as when I use your information to fulfill your order, provide customer service, or resolve disputes;
when you have provided your affirmative consent, which you may revoke at any time, such as if you separately agree to receive marketing emails from me;
if necessary to comply with a legal obligation, court order, or in connection with a legal claim, such as retaining information about purchases if required by tax law; and
as necessary for the purposes of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as improving my shop, maintaining accurate business records, and complying with Etsy’s Seller Policy and Terms of Use.

Information Sharing and Disclosure

Information about my customers is important to my business. I share your personal information only for very limited reasons and in limited circumstances, as follows:

Etsy. I share information with Etsy as necessary to provide you with my services and comply with my obligations under both the Etsy Seller Policy and Etsy Terms of Use.

Service providers. I may use trusted third parties to help operate my shop or business services, such as payment processing, email, file storage, bookkeeping, or tax preparation. I share your information with these third parties only to the extent necessary for them to perform those services.

Compliance with laws. I may collect, use, retain, and share your information if I have a good-faith belief that it is reasonably necessary to respond to legal process or government requests, enforce my agreements or policies, investigate fraud or other illegal activity, or protect the rights, property, and safety of my customers or others.

Business transfers. If I sell or merge my business, I may disclose your information as part of that transaction, only to the extent permitted by law.

Data Retention

I retain your personal information only for as long as necessary to provide you with my services and as described in this Privacy Policy. However, I may also be required to retain this information to comply with legal and regulatory obligations, resolve disputes, and enforce my agreements.

In general, I keep your information for up to 4 years, unless a longer retention period is required for tax, legal, or regulatory reasons.

Transfers of Personal Information Outside the EU

Etsy and certain third-party service providers may store or process your information outside your home country, including outside the European Union. As a result, your information may be transferred to jurisdictions with different data protection laws.

When I rely on third-party services, I do so only as necessary to operate my shop and fulfill orders. Where required, I rely on Etsy’s and those providers’ legal mechanisms for international data transfers.

Your Rights

If you reside in certain territories, including the EU, you may have a number of rights in relation to your personal information. These rights may include:

Access. You may have the right to access and receive a copy of the personal information I hold about you.

Change, restrict, or delete. You may also have rights to change, restrict my use of, or delete your personal information. Except where I am required to store data for legal reasons, I will generally delete your personal information upon request.

Object. You can object to my processing of some of your information based on my legitimate interests and to receiving marketing messages after providing consent to receive them.

Complain. If you reside in the EU and wish to raise a concern about my use of your information, you have the right to do so with your local data protection authority.
