Terms and Conditions:

1 - Ordering and Payment
All orders are binding. All orders from end customers are shipped against prepayment without exception. If payment is not received within 10 days of placing the order, we reserve the right to cancel the order. For payments from abroad, any fees incurred must be paid by the buyer. Unless otherwise stated, shipping will take place no later than 7 days after receipt of payment.

2 - Retention of title
The delivered goods remain our property until all our claims have been paid in full. We are entitled to withdraw from the purchase contract if payment for the goods is not made within 5 working days of order confirmation, and we are not obliged to reserve goods that have been ordered for longer than this period.

3 - Delivery
The choice of shipping method is at our discretion. Shipping and packaging costs are extra. Shipping risk is borne by the recipient.


4 - Delivery times and force majeure
Delivery times are always approximate. Delivery times agreed in writing are subject to unforeseen obstacles such as force majeure, official measures, delays in customs clearance, strikes, or operational disruptions. In this case, we are entitled to postpone delivery for the duration of the hindrance or to make a replacement delivery in consultation with the customer. If no agreement on a replacement delivery can be reached with the customer, we are entitled to withdraw from the contract in whole or in part. In this case, the customer has no right to cancel the contract. We do not accept claims for damages from our customers due to delayed delivery or non-delivery. A deterioration in the customer's circumstances after conclusion of the contract entitles us to withdraw from the contract at any time and releases us from the delivery deadline.

5 - Discrepancies
Color deviations from the screen display are due to technical reasons and therefore do not constitute grounds for complaint. Slight deviations from the negotiated product are possible due to the production process and are also not considered grounds for complaint.

6 - Custom-made products
Miniscule Deviations products that are specially manufactured according to specific characteristics and produced for a specific customer (custom-made products) are excluded from exchange.

7 - Insurance
Transport insurance only upon request and at the customer's expense.

8 - Transport damage
All deliveries are made at the risk of the purchaser. Damage to goods must be reported immediately upon receipt. Claims for damages can only be made against the supplier.

9 - Data storage
We are entitled to store the personal data of the order.

10 - Place of performance and jurisdiction
For end customers, exclusively Tyrol. The customer agrees to this by placing their order.

11 - Warranty
The statutory warranty provisions apply, unless otherwise specified in section 12 of these terms and conditions.

12 - Compensation
Claims for compensation by the customer – regardless of the legal basis – are limited to cases in which the provider or its vicarious agents have caused the damage intentionally or through gross negligence. The limitation period for claims for compensation is three years from the transfer of risk.

11 - Warranty
The statutory warranty provisions apply, unless otherwise specified in section 12 of these terms and conditions.

12 - Compensation

13 - Information on the right of withdrawal
You may withdraw from your contract within 14 days without giving reasons in writing (e.g. letter, email) or – if the goods are delivered to you before the deadline expires – by returning the goods. The period begins upon receipt of this information in writing, but not before the goods are received by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and also not before fulfillment of our information obligations pursuant to Article 246 § 2 in conjunction with § 1 paragraphs 1 and 2 EGBGB (Introductory Act to the German Civil Code) as well as our obligations pursuant to § 312g paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. The timely dispatch of the revocation or the goods is sufficient to comply with the revocation period.

14 - Consequences of withdrawal
In the event of an effective withdrawal, the services received by both parties must be returned and any benefits derived (e.g., interest) must be surrendered. If you are unable to return or surrender the services received and any benefits derived (e.g., advantages of use) to us, either in whole or in part, or only in a deteriorated condition, you must compensate us for the loss in value. You only have to pay compensation for the deterioration of the item and for any benefits derived if the use or deterioration is due to handling of the item that goes beyond the examination of its properties and functionality. “Examination of the properties and functionality” means testing and trying out the respective goods, as is possible and customary in a retail store.

Items that can be shipped by parcel post are to be returned at our risk. You shall bear the regular costs of the return shipment if the goods delivered correspond to those ordered. If the goods are returned to us postage unpaid, we are entitled to deduct the amount from the purchase price refund or to invoice you for it. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation declaration or the item, and for us with its receipt.

15 - Exclusion of the right of withdrawal
The right of withdrawal does not apply to distance contracts for the delivery of goods that are manufactured according to customer specifications or clearly tailored to personal needs (see point 6 of the General Terms and Conditions).

16 - Copyright and intellectual property rights
All products offered by Miniscule Deviations are based on ideas Elizabeth Russell and are therefore protected by copyright. They may not be copied, reproduced, or published without the permission of Elizabeth Russell , even in excerpts. Commercial use of my designs, including media, posts or content found on Miniscule Deviations websites, is prohibited and will be prosecuted under civil and criminal law. Use without prior express consent is not permitted.

17 - Scope of application
These general terms and conditions apply exclusively to the business relationships between Miniscule Deviations (Elizabeth Russell) and my customers. Miniscule Deviations does not recognize any terms and conditions that conflict with or deviate from these general terms and conditions and hereby expressly rejects them. Conflicting terms and conditions of the customer are only valid if Miniscule Deviations expressly agrees to them in writing.

18 - Final provisions
These general terms and conditions, as well as all contracts concluded between you and the provider, in particular purchase contracts, and all related ancillary transactions, are governed exclusively by Austrian substantive law, excluding the referral provisions of international private law. For consumer transactions, the statutory provisions of the KSchG (Consumer Protection Act) apply.

In the event of one or more provisions of these General Terms and Conditions being invalid, the validity of the remaining provisions shall remain unaffected.
